Fable Spark Terms of Use

Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the Fable Spark mobile application ("the App") and visiting our website at fablespark.hunersapps.com ("the Website") operated by Samet Safkan ("us", "we", or "our").
Your access to and use of the App and Website is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App and Website.
By accessing or using the App or Website, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the App or Website.
1. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App or Website after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App and Website.
2. Access and Use of the App
a. Eligibility:
The App is intended for use by parents and children aged 3-8. By using the App, you represent that you are at least 18 years old or have obtained parental consent if you are a minor. Children under 13 (or the equivalent age in your jurisdiction) may only use the App with the direct supervision and consent of a parent or legal guardian.
b. User Accounts:
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our App. You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
c. Permitted Use:
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
d. Prohibited Conduct:
You agree not to:
- Use the App or Website in any way that violates any applicable local, national, or international law or regulation.
- Use the App or Website for any purpose that is fraudulent, abusive, or otherwise illegal.
- Attempt to gain unauthorized access to the App, Website, or any related systems or networks.
- Interfere with or disrupt the integrity or performance of the App or Website.
- Use the App to generate content that is harmful, offensive, discriminatory, or inappropriate for children.
- Abuse the AI generation features, including but not limited to excessive or automated requests designed to bypass credit limits or cause undue load on our systems.
3. Intellectual Property Rights
a. App Ownership:
The App, Website, and their original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of Samet Safkan and its licensors. The App and Website are protected by copyright, trademark, and other laws of both the Turkey and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Samet Safkan.
b. User-Generated Content:
Any content you submit or generate through the App (e.g., story prompts, preferences) remains your property. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute such content solely for the purpose of operating and improving the App's services.
c. AI-Generated Content:
Stories, images, and audio generated by the App based on your prompts are considered AI-generated content. While you may use this content for personal, non-commercial purposes, the ownership and commercial rights to such content may be subject to the terms and conditions of the underlying AI models (Google Gemini, Runware.ai, Google Cloud Text-to-Speech). We do not claim ownership of the content generated by you through the App, but we do not grant any specific commercial rights beyond what is permitted by the underlying AI service providers. You are responsible for ensuring your use of AI-generated content complies with all applicable laws and third-party terms.
4. Subscriptions and Purchases
a. Subscription Terms:
The App offers subscriptions for premium features, including unlimited story generation. Subscriptions are available on a monthly or annual basis. By purchasing a subscription, you agree to pay the specified fees.
b. Billing and Auto-Renewal:
Subscriptions are billed in advance on a recurring, periodic basis (e.g., monthly or annually). Your subscription will automatically renew at the end of each billing period unless you cancel it or we cancel it. You will be charged for the next billing period unless you turn off auto-renewal at least 24 hours before the end of the current period.
c. Cancellation and Refunds:
You may cancel your subscription at any time through your App Store account settings. Cancellation will take effect at the end of the current billing period. Refunds are handled according to the App Store's refund policies. We do not directly process refunds for subscriptions.
d. Free Trials:
We may offer a free trial for a limited period. If you do not cancel your subscription before the free trial ends, you will be automatically charged for the selected subscription plan.
5. Disclaimers
The App and Website are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation or availability of the App or Website, or the accuracy, completeness, or reliability of any content generated by the AI. We do not warrant that the App or Website will be uninterrupted, secure, or error-free.
AI-generated content may contain inaccuracies, biases, or inappropriate material. While we strive to filter harmful content, we cannot guarantee that all generated content will be suitable for all ages or free from objectionable material. Parental supervision is always recommended.
6. Limitation of Liability
In no event shall Samet Safkan, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App or Website; (ii) any conduct or content of any third party on the App or Website; (iii) any content obtained from the App or Website; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
7. Indemnification
You agree to defend, indemnify, and hold harmless Samet Safkan and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App and Website, by you or any person using your account and password; b) a breach of these Terms; or c) Content posted on the App or Website.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App and Website will immediately cease. If you wish to terminate your account, you may simply discontinue using the App.
9. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our App and Website, and supersede and replace any prior agreements we might have between us regarding the App and Website.
10. Children's Use
The App is designed for children aged 3-8 with parental supervision. Parents are responsible for monitoring their children's use of the App and ensuring that their use complies with these Terms. We encourage parents to discuss online safety and privacy with their children.
11. Third-Party Links and Services
The App and Website may contain links to third-party websites or services that are not owned or controlled by Samet Safkan. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Samet Safkan shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
